Terms of Reference:
Implementation of Directive 90/384/EEC, to facilitate all aspects of implementation apart from inspection, enforcement and reverification. And to consider aspects of AWIs as far as necessary in support of the WELMEC type approval agreement and the Measuring Instruments Directive.

General Aspects of Legal Metrology

To look into general aspects of legal metrology derived from the purpose
and need for legal requirements for measuring instruments, such as:
  • how uncertainty is considered in legal metrology
  • the use of accuracy classes in connection to the purpose of legal requirements
  • the acceptable "failure rate" for different purposes and to work for harmonisation on these matters where needed taking into account ongoing discussions and development in OIML.

Metrological Supervision

Terms of Reference:

  1. Establish public confidence in legal metrology provisions by the promotion of equivalent and effective supervision levels in WELMEC Member States in support of consumer protection, users of measuring instruments, fair trade and a proper operation of the internal market.
  2. Sustain confidence in the CE Mark and the supplementary metrology mark.
  3. Organise and promote the exchange of information on metrological supervision matters between members.
  4. Promote the development of efficient methods for Market surveillance (NAWI and MID).
  5. Provide guidance on supervision matters to WELMEC member.
  6. Promote cooperation between members in market supervision matters.
  7. Assist in resolving problems concerning technical barriers to trade.
  8. Provide a means for dialogue with representatives, consumers, trade, industry and Commission officials.
  9. Maintain the currency of the Directory of European Legal Metrology, WELMEC 6.
  10. Facilitate and support the EMeTAS user group.

(The Terms of Reference were amended by the 19th WELMEC Committee at the meeting in Madrid in May 2003 in that:-

a. In 9,above, the Directory was renumbered WELMEC 5.1 instead of WELMEC 6

b. In 4 above, the new text was inserted to replace the old, which read ‘ Promote the development of efficient methods for supervision’)

Prepackages

Terms of Reference:

  1. Come to a uniform application of the directives and regulations relating to:
    • prepackaged products;
    • particular sizes,
    • packaging
    • sampling.
  2. Establish a platform for exchange of information on all matters relating to the sale of prepacked1 products sold by quantity (either under European or national legislation);
  3. As experts, give advice to the Commission on aspects to be considered in new and existing legislation relating to prepackages;
  4. Give opinions to Competent Departments; Packers and Importers on various practical issues relating to prepackages and other prepacked products.
  5. Produce practical guidance on checking products in the marketplace for compliance to European legislation on prepacked product.

To harmonize type approval practice and equivalent conformity assessment
procedures with respect to software that is critical for the metrological
characteristics of a measuring instrument by

  • developing and updating respective guidance for any party involved
  • considering state-of-the-art and upcoming technologies on the basis of European Directives (Measuring Instruments Directive and Directive 90/384/EEC), relevant International Standards and OIML

Measuring Instruments Directive

Terms of Reference:

The following terms of reference have been adopted for WELMEC WG 8 during the 20th WELMEC Committee ( Casta Papiernicka 13 – 14 May 2004) :

General application of MID , except market surveillance (scope of WG 5) and exchange of information (ad hoc group), in particular with a view to establishing guidance documents on :

  • conformity assessment modules,
  • appointment (criteria) of notified bodies,
  • operation of notified bodies.

In addition , WG 8 will take into account :

  • the definitions of MID and OIML (clarification where differences appear between MID and OIML vocabulary),
  • the organisation of MID implementation workshops.

Reminder

The here under specific aspects in relation with MID are not in the scope of WG 8 but are dealt with by the following WELMEC WGs:

WG 2 : automatic weighing machines

WG 4 : uncertainties of measurements, accuracy classes

WG 5 : market surveillance

Utility Meters

Terms of Reference:
  1. Identify unclear issues of MID concerning Utility Meters
  2. Development of guidelines for the application of conformity modules for utility meters and/or subassemblies including tests procedures and reports if needed
  3. Development of proposals for a coherent interpretation/application of special requirements of MID annexes
  4. Compatibility with interfaces concerning sub-assemblies and additional devices
  5. Definition of meter properties leading to a classification of a meter as inside the MID scope and definition of properties which are not covered by MID and consequently may be a matter of national regulations
  6. Participation in the development of Harmonised standards (draft mandate of CEN) concerning the scope and description of test procedures for utility meters
  7. Determination of further key aspects of activity concerning the Harmonisation of the interpretation of MID requirements by the notified bodies and needs of test guides for new techniques as a basic for future harmonised standards and harmonised documents (OIML recommendations)
  8. Contribute to the work of the corresponding OIML working groups

Ad-hoc Working Group for Information Exchange

Terms of Reference:

1. Define the contents of the administrative cooperation claimed in Article 18 of the MID concerning the information exchange about

  1. Market surveillance activities and their results
  2. EC-type examination and design examination
  3. Quality system approvals

2. Analyse existing Internet platforms (e.g. EMeTAS, ICSMS, different national databases for type approval and market surveillance activities) how far their concepts and technical solutions can be taken over to fulfil the requirements of the MID.

3. Proposal for technical solutions preferably based on Web technology, where the existing systems are not sufficient for an effective administrative cooperation.

4. Development of the proposal after acceptance by the committee.
